This Agreement constitutes your agreement with Pehliseedhi.com (LLP) (hereinafter referred to as “the website”) with respect to your use of the website. You must agree to abide by all the terms and conditions contained in this agreement, in order to become or remain an authorized user of the website.

I agree that the services provided by Pehliseedhi.com LLP intend to provide employment and recruitment solutions for suitable candidates and genuine jobs in existence only.

The user represents that he/she is not a minor, that he/she is 18 years of age and aboveand is responsible for all the actions taken by him/her, and is not under any legal or other disability which limits his/her ability to comply with these terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others. This website is addressed to adults only.

You further represent that you are not purchasing the products/services for resale to others and will not do so without the website’s prior written consent. Failure to comply with this agreement may result in legal actions.

The website reserves its right to change the look, feel, design, prominence, depiction, classification of any section of the website at any time without assigning any reason and without giving any notice.

The website is a public site with paid access only. It will commence providing services only upon receipt of amount/charges upfront either from subscriber or from a third party on behalf of the subscriber.

Apart from the registration fee, no extra charges are applicable for the services provided by the website until you are employed through our services. Only after you are employed through the website, it is entitled to get the subscriber’s half the 1st month’s salary (15 days salary of the 1st month only) as the website’s service charges/professional fee.

After appointment of the registered jobseeker by the registered employer (through Pehliseedhi.com), Pehliseedhi.com is entitled to receive the jobseeker’s salary of 15 days of the first month only, as its service charges/professional fee. Thereby, the jobseeker agrees to pay the said amount from his 1st month’s salary to Pehliseedhi.com through the employer on his/her behalf.

It is the duty and the sole responsibility of the employer to deduct 15 days salary of the 1st month only of the respective employee hired through Pehliseedhi.com and pay the deducted amount to Pehliseedhi.com as their service charges. The website reserves the right to collect the service charges/professional fee from the employer.

Pehliseedhi.com is entitled to receive the service charge amount from the employer on the 30th day from the jobseeker’s date of joining. If the service charges are not paid on the due date, that is, on the 30th day of the hiring date of the respective employee, then Pehliseedhi.com LLP will charge an interest amount of 20% per month in addition to the total service charges due.

Pehliseedhi.com offers a 10 day trial period to both, the employer and the jobseeker. If the employer or the jobseeker refuses to work with each other within this period, Pehliseedhi.com does not charge anything. However, if the jobseeker agrees to work on the 11th day, then he/she is liable to pay 15 days salary of his/her 1st month to Pehliseedhi.com. Failing to do so, he/she agrees that a legal action will and shall be taken against him/her.

The employer and jobseeker agree that they have read, understood, & accept all the terms and conditions. They also agree that in case of a breach of any terms or conditions, Pehliseedhi.com reserves the right to take a legal action against them.

This subscription is non-transferable i.e. it is for the same person throughout the period of the subscription.

The subscription will be valid up to a maximum of one year which will commence from the date of activation of the profile by Pehliseedhi.com.

The payment for the services, once subscribed to by the subscriber, is not refundable. The amount paid, entitles only the subscriber to the services by the website for the subscription period.

These paid services entitle the subscriber to add, modify, or change the data/information fed in by him or the website on his behalf, but does not entitle him to use the services to feed fresh insertion of information/data/resume of another person in place of the insertion or information/data already fed in.

The user expressly states that the resume/insertion of information/data being fed into the network of the website by the user is correct and complete, in all respects, and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. The user of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website. The website is not responsible for the use of any personal information that the user may choose to post on the website.

Details/contact information provided, as part of the registration, are expected to be genuine, and access to such details is available to authorized personnel only. Additionally, through this service, your resume is also made a part of the website’s proprietary database, accessed only by companies/recruiter registered with us.

The website expressly disclaims any liability arising out of the said resume/insertion of information/data so fed into its network by the user. Furthermore, the user agrees to indemnify the website for all the losses incurred by the website due to any false, distorted, manipulated, defamatory, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network of the website.

Upon registration, you agree to make your resume searchable/accessible to clients of the website and it has the right to make all such modifications/editing of resume in order to fit the resume in its database.

Jurisdiction for any disputes arising from and related to this contest shall be Jaipur, Rajasthan, India to the exclusion of all other courts.

Disputes shall be resolved in accordance with the laws of India as applicable

Background Check

Arbitration Clause

1. This Agreement shall be governed by and construed in accordance with the laws of India.

2. Subject to Clause 1.4, each of the Parties irrevocably agrees that the courts at Jaipur, State of Rajasthan shall have exclusive jurisdiction to settle any dispute, which may arise out of or in connection with this Agreement, and that accordingly any proceedings arising out of or in connection with this Agreement shall be brought in such courts. Each of the Parties irrevocably submits to the jurisdiction of such courts and waives any objection to proceedings in any such court on the ground of venue or on the ground that proceedings have been brought in an inconvenient forum.

3. Any dispute or claim arising out of or in connection with or relating to this Agreement or the breach, termination or invalidity hereof (“Dispute”) shall in the first instance, be attempted to be resolved amicably between the disputing parties.

4. In the event the parties to the Dispute (“Disputing Parties”) are not able to resolve the same amicably within [30 (thirty)] Business Days from the date on which the dispute arose, the same shall be referred to binding arbitration at the request in writing (“Dispute Notice”) of any Disputing Party in accordance with the [Arbitration and Conciliation Act, 1996] (the “Arbitration Act”), as may be modified from time to time.

5. The number of arbitrators shall be 3 (three) (“Arbitration Board”). The Disputing Parties shall appoint one arbitrator each and the two arbitrators shall appoint the third arbitrator (“Chairman”). In the event the two arbitrators so appointed are unable to appoint the third arbitrator, being the Chairman on the Arbitration Board, said appointment shall be made in accordance with the Arbitration Act.

6. All arbitration proceedings shall be conducted in the English language and the seat of arbitration shall be at Jaipur, State of Rajasthan. The Arbitration Board shall decide any such dispute or claim strictly in accordance with the governing law specified in Clause 1.1. Judgment upon any arbitral award rendered hereunder may be entered in any court having jurisdiction, or application may be made to such court for a judicial acceptance of the award and an order of enforcement, as the case may be. Each of the Party shall bear its own costs and expenses in relation to the arbitration.

7. [The Parties agree that the provisions of Sections 9, 27, 37 (1)(b) and 37 (3) of the Arbitration Act (as amended) shall be applicable to the arbitration proceedings in Clause 1].

For Employer:

I agree that the services provided by Pehliseedhi.com LLP intend to provide employment and recruitment solutions for suitable candidates and genuine jobs in existence only.

I do hereby solemnly affirm that the company is formed in compliance with all the legal provisions of law and does not violate and provisions of law as to best of my knowledge and belief.

Apart from the registration fee, no extra charges are applicable for the services provided by the website, for the subscription period.

The subscription will be valid upto a maximum of one year which will commence from the date of activation of the profile by Pehliseedhi.com.

The employer shall give an undertaking to the website that the jobs sought to be filled through later are in existence, genuine and the subscriber has the authority to recruit /advertise for such vacancies. Also the subscriber undertakes that the database will be used to contact candidates for jobs only.

I also agree that the employee database provided by Pehliseedhi.com will be used solely to contact candidates for employment purpose and for no other purpose, whatsoever.

The website shall only make recommendations of candidates as per the job availability and requirements posted by the employer, and, in no way, will select the candidate on anyone’s behalf.

The website only recommends candidates according to the jobs posted by you (employer) and will not/does not select candidates on anyone’s behalf. Selection and appointment of candidates is the sole responsibility of the employer. The website cannot be held liable for any fraud, misbehavior, unwanted activities, and unlawful acts during and after selection/appointment process of the candidate.

By using our services or by filling out any forms/agreements on or through the services, providing us with information or making an inquiry, you acknowledge that we have an established business relationship with you and you expressly consent to being contacted by us or our service providers, whether by phone, mobile phone, text (SMS), e-mail, postal mail or otherwise. From time to time, when you call us we may wish to record those phone calls for quality assurance and customer's/user's satisfaction purposes. In those jurisdictions where consent is required in order for a party to record any telephone call, you consent for us to record your call when you call us.

Upon registration, you agree making your resume searchable to the clients of Pehliseedhi.com. Pehliseedhi.com has the right to make all such modifications/editing of resume in order to fit the resume in its database.

Through Resume Display service, your resume is made available from the home page of Pehliseedhi.com and can be freely accessed by other users of Pehliseedhi.com. The information will be available to all the users of Pehliseedhi.com so as to get a good response to your query.
